Terms of Use

Decider is operated by Nightwave. By accessing or using the service, or by creating an account, you agree to these terms and to our privacy policy. If you do not agree, you should not use the service. If you use the service on behalf of an organisation, you confirm that you are authorised to accept these terms on its behalf.

The service is intended for users aged 16 or over. You may not use the service if you are below that age or if applicable law prevents you from doing so.

Decider allows you to propose times, share a link with others and collect responses in order to agree on a meeting time. Certain features require an account, while others may be used by anyone holding a valid link. We may add, modify or withdraw features at any time.

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your sign-in credentials, and for all activity that takes place under your account. You must notify us promptly if you believe your account has been accessed without your authorisation.

You agree not to use the service to send unsolicited or bulk messages, to harass, threaten or defame others, to distribute malware or unlawful material, to impersonate any person or entity, or to infringe the rights of others. You further agree not to interfere with or disrupt the service, to circumvent its technical or security measures, or to access it by automated means in a manner that places an unreasonable load on it.

Links to shared content are unlisted rather than confidential. You should not use the service to collect or share information that would be harmful if accessed by anyone holding the link.

You retain ownership of the content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely to the extent necessary to operate and support the service. We do not use your content for any other purpose.

You are responsible for ensuring that you have the necessary rights and permissions for the content you submit, including any personal data relating to other individuals.

The service may link to or interoperate with services provided by third parties, such as sign-in and calendar providers. Those services are governed by their own terms and privacy notices, and we are not responsible for them.

The service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error free or secure, and we may suspend access for maintenance, security or operational reasons.

Content that has been inactive for 90 days is deleted automatically. You should export or otherwise record anything you need to retain before that period elapses, as the service is not intended to be used as a system of record. Further information is set out in our privacy policy.

We may remove content and suspend or terminate access to the service where we reasonably believe these terms have been breached, where required by law, or where necessary to protect the service or its users. Where appropriate, we will inform you of the reason and give you an opportunity to respond. You may stop using the service and request deletion of your account at any time.

The service is currently provided free of charge. If paid plans are introduced, the applicable terms and prices will be presented before any purchase, and functionality that is free today will not be charged for retroactively. Current details are available on the pricing page.

To the fullest extent permitted by law, Nightwave shall not be liable for any indirect, incidental or consequential loss, including loss of profits, business, goodwill or data, arising out of or in connection with your use of the service. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, and if you are a consumer, your statutory rights are not affected.

You agree to indemnify us against claims, losses and reasonable costs arising from your misuse of the service, from content you submit, or from your breach of these terms or of applicable law.

These terms are governed by Swedish law, without regard to its conflict of law rules, and the courts of Sweden shall have jurisdiction. If you are a consumer, you may also benefit from mandatory protections and venues available in your country of residence.

We may update these terms from time to time. The date shown at the top of this page reflects the latest revision, and continued use of the service after a change constitutes acceptance of the updated terms.
